1. Definitions
SendPol: SendPol, located at Research Campus 18, 3500 Hasselt, Belgium, VAT number BE0720733358.
Customer: The natural or legal person who uses the services of SendPol.
Services: The SendPol plugins and associated services for Peppol integration.
2. Applicability
These terms and conditions apply to all offers, quotations, and agreements between SendPol and the Customer.
By using our services, the Customer agrees to these terms.
3. Service Provision
SendPol offers plugins for various e-commerce platforms that allow webshops to integrate with the Peppol network for automated B2B transactions.
SendPol strives to deliver the services with the utmost care, but cannot guarantee 100% uptime.
The Customer is responsible for providing correct data and complying with Peppol standards.
4. Subscriptions and Payment
All subscriptions are invoiced monthly or annually in advance, depending on the chosen payment period.
You can start sending invoices for free with the Start package. You only pay for the packages you use.
In case of non-payment, SendPol reserves the right to suspend the service provision until payment has been made.
5. Termination
Subscriptions can be terminated by both parties with a notice period of one month, ending on the last day of a billing period.
Termination can be done via email to [email protected] or via the customer portal.
Upon termination, all rights to use the services expire as of the end date.
6. Intellectual Property
All intellectual property rights of the SendPol software and documentation belong to SendPol.
The Customer receives a non-exclusive, non-transferable right to use for the duration of the subscription.
7. Privacy and Data Protection
SendPol respects the privacy of its customers and acts in accordance with the General Data Protection Regulation (GDPR).

The retention period for documents sent via SendPol depends on your subscription plan: Free (1 month), Solo (2 months), Grow (3 months), Agency (4 months). For Enterprise subscriptions, the retention period is determined in consultation. After this period, documents are automatically deleted.
8. Liability
SendPol is not liable for indirect damage, consequential damage, or lost profits resulting from the use of the services.
The total liability of SendPol is limited to the amount paid by the Customer in the 12 months preceding the damage.
9. Changes
SendPol reserves the right to change these terms. Changes will be announced at least 30 days in advance.
Continued use after changes is considered acceptance of the new terms.
10. Applicable Law
Belgian law applies to this agreement.
Disputes will be submitted to the competent court in Hasselt, Belgium.
